This meeting will be held electronically in accordance with Ministerial Order No. M192 issued June 17, 2020. Meetings are transmitted via the Board Room, located at 175 Ingram Street, Duncan  BC

APPROVAL OF AGENDA

Motion to approve the agenda.

2.

PUBLIC INPUT PERIOD
 

The purpose of the Public Input Period is to provide the public with an opportunity to comment on an agenda item before the Board / Committee / Commission considers the item. The Public Input Period Procedure Policy provides for the public input period to proceed in a timely fashion. Public Input Period items cannot include matters which are, or have been, the subject of a Public Hearing.

REPORTS

R1.

Report from the Community Planning Division Re: HOCP MOCP Update

Recommendation That it be recommended to the Board:
1. That 2nd reading of “CVRD Bylaw No. 4270 – Cowichan Valley Regional District Official Community Plan for the Electoral Areas Bylaw, 2020”, be rescinded.
2. That “CVRD Bylaw No. 4270 – Cowichan Valley Regional District Official Community Plan for the Electoral Areas Bylaw, 2020” be amended as outlined in the Staff Report to the July 7, 2021, Special Electoral Area Services Committee meeting.
3. That “CVRD Bylaw No. 4270 – Cowichan Valley Regional District Official Community Plan for the Electoral Areas Bylaw, 2020”, be forwarded to the Board for consideration of 2nd reading as amended.
4. That “CVRD Bylaw No. 4270 - Cowichan Valley Regional District Official Community Plan for the Electoral Areas Bylaw, 2020”, be considered in conjunction with the CVRD’s Five Year Financial and Solid Waste Management Plans.
5. That a public hearing be held for “CVRD Bylaw No. 4270 – Cowichan Valley Regional District Official Community Plan for the Electoral Areas Bylaw, 2020”, with all electoral area directors as delegates.
6. That “CVRD Bylaw No. 4329 – Cowichan Valley Regional District Bylaw Revision Bylaw (Official Community Plan and Zoning Bylaws), 2020”, be forwarded to the Board for consideration of 3rd reading and adoption.
7. That a public hearing be held for “CVRD Bylaw No. 4330 – Zoning Bylaw Harmonization Bylaw, 2020” with all electoral area directors as delegates.
8. That in respect of any official community plan amendment bylaw that has already been given readings and would be incapable of being adopted if Bylaw No. 4270 is adopted, staff be authorized to revise the amendment bylaw prior to presentation to the Board for 3rd reading or adoption, to the extent permitted by section 470 (1) (b) of the Local Government Act and required to enable the Board to adopt the bylaw as an amendment to CVRD Bylaw No. 4270 – Cowichan Valley Regional District Official Community Plan for the Electoral Areas Bylaw, 2020.
9. That the Engagement and Consultation Plan for the OCP Modernization process, as outlined in the staff report to the July 7, 2021, Special Electoral Area Services Committee meeting, be approved.
10. That staff prepare a report on recommendations to amend “CVRD Bylaw 3544 - Advisory Planning Commission Establishment Bylaw, 2011”.

Report from the Community Planning Division Re: CVRD Non-Conforming Dwellings Policy 1991

Recommendation That it be recommended to the Board that the CVRD Non-Conforming Dwellings Policy 1991 be rescinded.

Report from the Community Planning Division Re: CVRD Letters of Comfort for Non-Conforming Siting Policy 1994

Recommendation That it be recommended to the Board that the CVRD Letters of Comfort for Non-Conforming Siting Policy 1994 be rescinded.

Recommendation That it be recommended to the Board that the CVRD Modular and Mobile Homes Policy 2009 be rescinded.

Recommendation That it be recommended to the Board that the CVRD Short Term Rental of Single Family Dwellings Policy 2012 be rescinded.

Recommendation That it be recommended to the Board that the CVRD Seasonal Cabins Policy 2017 be rescinded.
   
R7.

Report from the Community Planning Division Re: CVRD Manufactured Home Park Bylaw 4367 and Re-Development Policy 2021

Recommendation That it be recommended to the Board:
1. That the revised Manufactured Home Park Re-Development Policy be approved;
2. That “CVRD Bylaw No. 4367 - Manufactured Home Park Bylaw, 2021” be forwarded to the Board for 1st and 2nd reading; and
3. That the public hearing for Bylaw No. 4367 be waived in accordance with sections 464(2) and 467 of the Local Government Act.

Report from the Community Planning Division Re: CVRD Bylaw No. 4349 Cannabis Uses, 2021

Recommendation That it be recommended to the Board:
1. That “CVRD Bylaw No. 4349 - Cannabis Uses, 2021” be forwarded to the Board for consideration of 1st and 2nd reading.
2. That “CVRD Bylaw No. 4349 - Cannabis Uses, 2021” be referred to the Ministry of Agriculture, Agricultural Land Commission, RCMP, Municipality of North Cowichan, City of Duncan, Town of Lake Cowichan, Town of Ladysmith, Cowichan School District 79, Ladysmith-Nanaimo School District 68, the following First Nations: Cowichan Tribes, Ditidaht, Halalt, Lyackson, Malahat, Pauquachin, Penelakut, Stz’uminus and Ts’uubaa-asatx.
3. That the revised CVRD Cannabis Production Facility Land Use Application Policy be approved.
4. That the revised CVRD Cannabis Retail Store Application Criteria Policy be approved.
5. That CVRD Cannabis Regulation Bylaw Enforcement Policy 2018 be rescinded.
