Recommendation
That the minutes of the Electoral Area Services Committee meeting of January 17, 2024, be adopted.
The Public Input Period is to offer the public an opportunity to comment on an agenda item before the Committee considers the item. The Public Input Period Procedure Policy allows for an allotment of 15 minutes, where the speaker is welcome to comment on any item(s) on the agenda up to a maximum of 3 minutes. This excludes items that are or have been the subject of a Public Hearing. The speaker should comment in a polite, calm, and courteous manner using respectful language, civility, and decorum.

Grant-in-Aid Request, Electoral Area C – Cobble Hill Re: RCMSAR34 Marine Rescue Society
Recommendation
That it be recommended to the Board that a Grant-in-Aid, Electoral Area C – Cobble Hill, in the amount of $1,000 be provided to the RCMSAR34 Marine Rescue Society to support repairs to rescue equipment, a planned boat lift and replacement or rebuild of the vessel in 2027.
Grant-in-Aid Request, Electoral Area I – Youbou/Meade Creek Re: Lake Cowichan School
Recommendation
That it be recommended to the Board that a Grant-in-Aid, Electoral Area I – Youbou/Meade Creek, in the amount of $500 be provided to the Lake Cowichan School for a $500 Bursary for a 2024 graduating student that resides in Electoral Area I – Youbou/Meade Creek to support their future education or training.
Report from the Development Services Division Re: Application No. SA21C08 (3668 Telegraph Road/PID: 006-658-555)
Recommendation
That it be recommended to the Board that Proposed Lot 2 in Subdivision Application No. SA21C08 (3668 Telegraph Road/PID: 006-658-555), be exempted from the minimum parcel frontage requirement in accordance with Section 512 of the Local Government Act.
Report from the Development Services Division Re: Application No. ALR23D01 (2279 Cowichan Bay Road/PIDs: 002-032-767 and 002-032-783)
Recommendation
That it be recommended to the Board that Application No. ALR23D01 (2279 Cowichan Bay Road/ PIDs: 002-032-767 and 002-032-783), be forwarded to the Agricultural Land Commission with the following comments:
1. The proposed activities are consistent with permitted uses in the Electoral Area D – Cowichan Bay (Upland) Zoning Bylaw No. 3705; and
2. The proposed activities are consistent with policies in the Official Community Plan for the Electoral Areas Bylaw No. 4270 that support local food production, ecological restoration and climate change mitigation measures.
Report from the Utilities Division Re: Cameron Farms Inclusion into the Arbutus Ridge Water System Service Area Request
Recommendation
That it be recommended to the Board:
1. That CVRD Bylaw No. 3286 – Arbutus Ridge Water System Service Establishment Bylaw, 2009 be amended to include the property described in the Arbutus Ridge Water System Service Area Certificate of Sufficiency dated January 12, 2024; and,
2. That the amendment to Bylaw 3286 be forwarded to the Board for consideration of three readings and adoption.
Report from the Parks & Trails Division Re: Electoral Area A - Mill Bay/Malahat Statutory Right of Way Discharge between Fawn Terrace and Lodgepole Road
Recommendation
That it be recommended to the Board that Statutory Right of Way EG110164 be discharged from several properties between Fawn Road and Lodgepole Road (specifically PIDs: 018-390-421, 018-390-404, 023-517-531, 023-517-557; and the Common Property of VIS4065), subject to a financial amenity contribution from the property owners (the applicants) to the Electoral Area A Community Parks Capital Reserve Fund equal to the fair market value of the Statutory Right of Way as determined by a certified land appraiser.
Report from the Inspection & Enforcement Division Re: Bylaw Dispute Adjudication System
Recommendation
That it be recommended to the Board:
1. That staff prepare bylaws, policies and agreements for the implementation of the Bylaw Dispute Adjudication System provided for in the Local Government Bylaw Notice Enforcement Act, for the Board’s approval.
2. That staff work with the Justice Services Branch, Ministry of Attorney General, to request the Lieutenant Governor in Council of the Province of British Columbia enact a Regulation under Section 29 of the Local Government Bylaw Notice Enforcement Act, to apply the Act to the Cowichan Valley Regional District.
Report from the Community Planning Division Re: Implementing the Requirements of the Housing Statutes (Residential Development) Act - Bill 44
Recommendation
That it be recommended to the Board:
1. That the draft amendment bylaws attached to the staff report dated January 30, 2024, for the purpose of increasing opportunities for suites in CVRD electoral areas, consistent with Provincial policies and legislation, be forwarded to the Board for consideration;
2. That amendment bylaws applicable to lands within 800 m of a Controlled Access Highway be referred to the Ministry of Transportation and Infrastructure; and
3. That a public hearing not be held and that notice be provided in accordance with CVRD Bylaw No. 4483 – Development Application Procedures Bylaw, 2023.
The Question Period is an opportunity to offer the public to ask a question regarding the business of CVRD. The Question Period allows for an allotment of 15 minutes and is comprised of two parts. The first is reserved for questions directly related to agenda items. If there is time remaining, questions may be on a matter of public interest related to and in the CVRD jurisdiction. Each questioner is permitted to ask one question, plus one follow-up question related to the answer. The Question must truly be a question, and not a statement of opinion, or speech. Questioners must avoid personal references, insinuations, violent, offensive, or disrespectful remarks about another person; and unparliamentary language.
